Business Name: Royal Swimming (“Company,” “we,” “us,” or “our”)

These Terms of Service (“Terms”) govern all orders placed with Royal Swimming for custom swim caps and related products. By placing an order, approving artwork, or submitting payment, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.

• All orders must be paid in full prior to production unless otherwise agreed in writing.
• Quotes are valid for 14 days unless otherwise stated.
• Pricing is subject to change based on final design, quantity, or material adjustments.

• Customers are responsible for reviewing and approving all artwork proofs before production.
• Approval confirms that all details—including spelling, colors, logos, and placement—are correct.
• The Company is not responsible for errors once artwork has been approved.
• Any changes requested after approval may result in additional fees and production delays.

• By submitting logos, designs, or artwork, you represent and warrant that you have the legal right to use them.
• The Company is not responsible for verifying trademark, copyright, or licensing rights.
• The Customer assumes full liability for any claims, damages, or legal actions resulting from unauthorized use of intellectual property.
• The Customer agrees to indemnify and hold harmless the Company from any such claims.

• Estimated production timelines are provided as a guideline and are not guaranteed.
• Delays may occur due to supply chain issues, design revisions, or unforeseen circumstances.
• The Company is not liable for delays outside of its control.

• Shipping timelines are estimates and depend on the carrier.
• The Company is not responsible for delays, damage, or loss caused by shipping carriers.
• Risk of loss transfers to the Customer once the order is shipped.

• Due to the custom nature of products, all sales are final.
• Refunds or replacements will only be issued for manufacturing defects or errors caused by the Company.
• Claims must be submitted within 7 days of delivery with photo evidence.
• Minor variations in color, size, or placement are normal and not considered defects.

• If payment terms are extended and not met, a late fee of 1.5% per month (18% annually) or the maximum allowed by law may be applied to outstanding balances.
• The Customer agrees to pay all costs associated with collection of unpaid balances, including legal fees, court costs, and collection agency fees.

• Orders cannot be canceled once production has started.
• Any approved cancellations prior to production may be subject to administrative and design fees.

• The Company’s liability is limited to the total amount paid for the order.
• The Company is not liable for indirect, incidental, or consequential damages, including lost profits, missed events, or reputational harm.

• The Customer assumes all responsibility for the use of the products.
• The Company is not liable for misuse, improper care, or failure to follow recommended usage guidelines.

• These Terms shall be governed by and construed in accordance with the laws of the State of Utah.
• Any disputes shall be resolved in the appropriate courts located in Utah County, Utah.

By placing an order and submitting payment, you acknowledge that you have read, understood, and agree to these Terms of Service.
